1. Type

These general terms of use regulate the legal framework for the use of the internet platform EvaDAT ("EvaDAT") operated by the connectINGs GmbH. They apply between the user and the connectINGs GmbH, Kronenstr. 6, 42285 Wuppertal, represented by the managing director Dr.-Ing. Kirsten Stop ("connectINGs").

The platform is aimed at users and producers of engineering software. EvaDAT is a free platform for quality assurance of software-based structural analysis based on the VDI 6201 guideline, where software users and producers can interactively call up standardized, qualified and neutral evaluation examples for their own test purposes and contribute to the creation of further examples.

2. General conditions for using the internet platform

In order to be able to use EvaDAT`s offer to the full extent, i.e. to view evaluation examples in full and to participate in the creation of examples, the user must register free of charge with name, email address and password. Only natural persons who are of legal age and belong to a company or an institution may register. Exceptions to this rule are possible in individual cases and can be requested by email at community@evadat.com. The decision in this regard is the sole responsibility of connectINGs.

There is no right to registration. connectings reserves the right to refuse registrations. The registration can be deleted at any time, but contributions can remain.

The password chosen during registration must be kept confidential and may not be disclosed to third parties. Users are not permitted to allow third parties to use EvaDAT with external data. Loss and misuse must be reported immediately.

In the EvaDAT Community - a user directory that can also be viewed by non-registered users - only company or institution names of registered users are listed. Names of users are not mentioned here. If several users of a company or an institution register, this is registered by a number. The number of qualified results posted by the users of the respective company or institution is also recorded here. The company or the institution has the right to object to the entry by sending an email to community@evadat.com.

In order to create a new example, three users using three different software programs need to come together via the platform. The users involved in the creation are publicly named as authors of the example with their names and company/institution.

In the commentary on EvaDAT, the user must observe the social principles of respectful and polite interaction with each other. It is forbidden to publish content other than that which corresponds to the objectives of the database. Violations can lead to deletion and to temporary or permanent exclusion.

3. Copyright/Rights of use

The offer is protected by copyright regulations from duplication and misuse. The unlawful duplication, distribution or publication of contents of the offer or their imitation beyond the granted right of use is not permitted.

connectINGs reserves all rights to the publication of the contents. The user has the right to use the evaluation examples easily. The user is not permitted to copy, modify, distribute or reprint the contents beyond the contractual agreement, especially to use them for the creation of a database or to pass it on to third parties. The user himself remains responsible for contents he has posted (see 5. Warranty and Liability). He may also publish these under his own name.

4. Warranty and liability

connectings does not warrant that the offer is always available and error-free. This applies in particular to the extent that access to the offer is caused by disruptions that are beyond the scope of connectINGs.

Each user is responsible for the content he posts in EvaDAT. Each user assures that they have the necessary rights to the content and that they do not violate the rights of third parties.

The user indemnifies connectINGs from all claims that other users or other third parties assert against connectINGs due to a culpable violation of their rights by content posted by the user within EvaDAT.

connectings is not liable for the accuracy, completeness and timeliness of the data. Nor does connectINGs guarantee the usability of the data of its users. Insofar as the use of the data against the user asserts claims for alleged violations of privacy rights, connectINGs is not responsible for this.

connectings shall not be liable for damages resulting from improper or improper use of the Internet platform by the user, misuse or loss of the identification features or the data stored by him.

connectings is responsible for its own content under the general laws. EvaDAT contains links to external websites of third parties on whose contents connectINGs has no influence. Therefore, connectINGs can not assume any liability for this external content. The content of the linked pages is always the responsibility of the respective provider or operator of the pages. The linked pages were checked for possible legal violations at the time of linking. Illegal content was not recognizable at the time of linking. However, a permanent content control of the linked pages is not reasonable without concrete evidence of a violation of law. Upon notification of violations connectings will remove such links immediately.

6. Amendments to EvaDAT and Terms of Use

connectINGs reserves the right to limit or change EvaDAT at any time, in whole or in part, without giving reasons. ConnectINGs will promptly inform users of the intended change to EvaDAT and changes to these Terms of Use.

7. Final provisions

Should one of these provisions be ineffective, this will not affect the validity of the remaining provisions. Ineffective provisions will be replaced by such effective regulations that largely achieve the intended economic and legal purpose.
